Who this covers

This policy explains how Éclat Investments (“we”, “us”) collects, uses, and protects personal information in connection with our internal business portal at eclatportal.com and our text messaging program. The portal is a private system used by our employees, staff, and authorized contractors to run day-to-day operations. It is not a consumer product and is not open to the general public.

Our text messaging program

We use SMS and voice messaging for three internal purposes only:

• Account security. One-time passcodes sent to a user signing in to the portal, to verify their identity.
• Operational notifications. Work-related messages to our staff — schedule reminders, task assignments, property and maintenance updates, and similar announcements, sent either immediately or on a recurring schedule.
• Inbound notes. Staff may send a text message to, or leave a recorded voice memo on, our business number. We store the message, any attached photo, and (for voice memos) the audio recording and its transcript, so the note can be logged against the right job or project in the portal.

We do not send marketing, promotional, advertising, or sales messages of any kind through this program, and we do not message members of the general public.

How consent is obtained

Only people with a portal account receive messages from us, and only after that person’s own phone has confirmed it by text. When a mobile number is added to someone’s profile, the number is immediately sent a request to confirm, and it receives nothing further unless it replies YES. Consent cannot be given on another person’s behalf. We never buy, rent, or import phone number lists, and we never message a number that has not confirmed for itself. A user may withdraw consent at any time by replying STOP to any message, or by asking an administrator to remove their number from their profile. We record the withdrawal against that number and stop sending to it; replying START is how someone chooses to return. Withdrawing consent from the messaging program does not affect their portal account.

Mobile information sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are never shared with any third party for any purpose.

We share mobile numbers with one category of party only: the licensed communications provider that transmits the messages on our behalf (our SMS and voice carrier). That provider acts solely as our service provider, may use the information only to deliver the messages we send, and is contractually barred from using it for its own marketing. We may also disclose information where we are legally required to, such as in response to a valid subpoena or court order. We do not sell personal information.

What we collect

• Account information — name, username, work email address, and mobile phone number.
• Messaging data — the content, date, and time of messages sent to or received from you through our business number, including photos you attach and, for voice memos, the audio recording and its transcript.
• Delivery records — whether a message was sent, delivered, or failed, kept so we can tell whether an important notification reached its recipient.
• Portal usage — the records you create and edit in the portal, and sign-in activity, kept for security and audit purposes.

How we use it

We use this information to verify sign-ins, deliver the operational messages described above, log the notes you send us against the correct job or project, maintain an audit trail of business communications, and secure and troubleshoot the portal. We do not use it for advertising, we do not use it to build marketing profiles, and we do not use automated decision-making that produces legal effects.

Opting out and getting help

Reply STOP to any message to stop receiving texts from us. Reply HELP for help, or contact us at the address below. Message frequency varies with your role and workload. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. The full messaging terms are in our Terms of Service.

Retention and security

Messages and their attachments are retained for as long as the underlying business record is active, and then archived under our normal records-retention practice. Data is held in access-controlled cloud infrastructure, transmitted over encrypted connections, and reachable only by authenticated users whose permissions grant them access to that part of the portal.

Your choices

You may ask us to show you the personal information we hold about you, correct it, or delete it, and you may withdraw consent to messaging at any time. Write to us at the address below and we will respond within a reasonable period.

Changes

We may update this policy from time to time. The revision date at the top of the page reflects the current version, and material changes will be communicated to portal users.
